Welcome to Mamuupayz Mobile Application ("Mamuupayz"). This page details the terms and conditions ("Terms") on which we offer the services ("Services") on the Mobile App. Please read these Terms carefully before using Mamuupayz. You understand that by using Mamuupayz, you are deemed to have accepted these Terms, regardless of how you subscribe to or use the services of the Mobile App. These Terms of Service and various other policies are binding under relevant provisions of the Information Technology Act of 2000.

In these Terms, references to "you", "User", "Your" shall mean the end user/shopper/customer accessing the Mobile App, its contents and using the Services offered through the Mobile App. "We", "Us", "Our" shall mean MAMUU International Private Limited and its affiliates.

When You use any of the services provided by Us through the Mobile App, including but not limited to, e.g. Payment at merchant locations, prepaid recharges, bill payments for utilities, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to you. It is your responsibility to review these Terms of Use periodically for updates / changes. Your continued use of the Mobile app following the posting of changes will mean that You accept and agree to the revisions. As long as you comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Mobile app. ACCESSING, BROWSING OR OTHERWISE USING MAMUUPAYZ INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Mamuupayz Policies, including but not limited to the Privacy Policy, as amended from time to time.

Membership Eligibility

Use of Mamuupayz is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use Mamuupayz. If you are a minor i.e. under the age of 18 years, you shall not register as a User of Mamuupayz and shall not transact. As a minor if you wish to use or transact on Mamuupayz, such use or transaction may be made by your legal guardian or parents on Mamuupayz. Mamuupayz reserves the right to terminate your membership and / or refuse to provide you with access if it is brought to our notice or if it is discovered that you are under the age of 18 years.

Mamuupayz Service

Mamuupayz is a mobile Payment application which allows users to pay to merchants for goods or services purchased. Users can pay using Mamuupayz to merchants who are signed up on Mamuupayz Merchant Network. Mamuupayz is a payment Service Provider only and does not sell goods or services. Mamuupayz is not and cannot be a party to or control in any manner any transaction between the Users and merchants. Mamuupayz system is PCI-DSS certified and adheres to Mobile Payment guidelines prescribed by RBI. Mamuupayz allows the user to make Payment transactions In-store at merchant location using your mobile phone Bill & Utilities payments incl. mobile prepaid recharges, electricity bills Online at certain merchants In above cases, users are allowed to make a payment using various payment instruments which includes Bank Accounts (using IMPS) and Credit and Debit Cards. The payment instruments and all data are securely stored in Mamuupayz systems which are PCI-DSS compliant and certified. Mamuupayz is completely compliant with Reserve Bank of India (RBI) Mobile Payment guidelines.

Registration

As part of registration process of Mamuupayz, user provides his/her mobile number. Mobile number verification is done by Mamuupayz. On successful verification, user is asked to generate a 6 digit secure PIN. This PIN would be required to access the Mamuupayz application every time. The user is supposed to keep this PIN secret and not share with anybody.

Storing Payment Instruments

User can configure his/her Bank accounts or Credit/Debit Card supported on Mamuupayz. As part of the configuration, Mamuupayz application sends SMS messages to the configured Bank or Credit/Debit Card Issuing Banks to authorize the account/cards. All the Payment instruments are stored securely in Mamuupayz systems which are PCI-DSS compliant and certified.

How to Use Mamuupayz

At the time of payment, user needs to provide 6 digit PIN to access the application. User chooses the Payment Instrument (Bank account or Card) and then requests for the One Time Password (OTP) for the transaction. On receiving the OTP, user takes the phone within 3 inches of the Merchants phone and clicks on “Initiate Payment” to initiate the payment. User gets the invoice on his/her phone which clearly displays the Merchant Name and the amount that the merchant is charging the customer. The customer needs to validate the amount and then click on “Pay Now” to complete the payment. The status of the transaction is then shown to the user.

Permissible Payment Transaction

The user may only use Mamuupayz Payment System to process a payment for goods or service that is purchased from a seller through a legitimate, bona fide sale of the goods or service. You may not use theMamuupayz service to purchase any goods or services which are illegal as per the Terms of agreement or Applicable Law of the country.

General Terms Related to use of Mamuupayz

User acknowledges that the payment transaction through Mamuupayz app is between the user and the merchant and not with Mamuupayz Mamuupayz may be used within India for Indian Rupee Transaction. Mamuupayz doesn’t support payment in foreign currencies Mamuupayz may impose transaction limits on usage in various merchants. User may contact Mamuupayz Customer Support in case of any queries related to the service or transaction. The customer support phone number is provided in the Mamuupayz App. The Mamuupayz application will send SMS message for authentication and OTP generation. You might incur a nominal cost (as per your telco’s plan) in sending these SMS message and the application will take your consent from you before doing the same

Offers & Rewards

Mamuupayz would provide limited period offers from time to time and reserves the right to apply or revoke the offer. Mamuupayz reserves the right to decide which payments qualify for the cash back offer. The current offer would be displayed clearly in the “Offers & Rewards” section of the Mamuupayz Mobile application. While the payment transaction in Mamuupayz doesn’t require internet facility on the customer mobile, having a mobile internet facility on the phone would aid in getting timely updates of the offers from time to time.

When You use Mamuupayz or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

Refund Policy

You are responsible for the receipt of the goods or services from the Merchant in lieu of which the payment has been made. Mamuupayz is not responsible for any purchase for which the said goods or services have not been received by you from the merchant. However, in case of issues in transactions, you may contact our customer support for resolution.

Mobile Recharges

We are a Reseller Only. Mamuupayz does not provide mobile service and is only a reseller of prepaid mobile services by telecommunications service providers or the providers of such prepaid recharge (the 'Telco' or 'Telcos') or other distributors or aggregators of such Telco’s. Recharge sold by us to you is sold without recourse against us for any breach of contract by the Telco.

Bill Payments

From time to time, Mamuupayz, at its sole discretion, can add to or delete from such list of Billers that can be used in respect of making payments to a Biller. Mamuupayz assumes no responsibility and shall incur no liability if it is unable to affect any Payment Instruction(s) on the Payment Date owing to any one or more of the following circumstances: If the Payment Account has insufficient funds/limits to cover for the amount as mentioned in the Payment Instruction(s) If payment is not processed by biller upon receipt. Circumstances beyond the control of Mamuupayz (including, but not limited to, fire, flood, natural disasters, bank strikes, power failure, systems failure like computer or telephone lines breakdown due to an unforeseeable cause or interference from an outside force). In case the bill payment is not effected for any reason, you will be intimated about the failed payment.

Indemnification

You will indemnify, defend, and hold Mamuupayz and its payment processors (and respective employees, directors, agents, affiliates and representatives) harmless from and against any and all claims, costs, losses, damages, judgments, tax assessments, penalties, interest, and expenses arising out of any claim, action, audit, investigation, inquiry, or other proceeding instituted by a person or entity that arises out of or relates to: (a) any actual or alleged breach of your representations, warranties, or obligations, including without limitation any violation of policies; (b) Your wrongful or improper use of the Mamuupayz; (c) any transaction submitted by you through Mamuupayz (including without limitation the accuracy of any Seller Content or product, service, or transaction information that you provide or any claim or dispute arising out of products or services offered or sold by you); (d) Your violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights; (e) Your violation of any law, rule or regulation of the Indian Government or any other country.

To the maximum extent permitted by applicable law, in no event shall Mamuupayz, its processors, service providers, suppliers, or licensors (or their respective affiliates, agents, directors, or employees) be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, inability to use, or unavailability of the services. Under no circumstances will Mamuupayz be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the services by you, or the information contained therein. In no event shall Mamuupayz, its processors, service providers, agents, suppliers, or licensors (or their respective affiliates, agents, directors, or employees) be liable to you for any claims, proceedings, liabilities, obligations, damages, losses or costs in an amount exceeding the amount of fees earned by Mamuupayz in connection with your use of the services during the three (3) month period immediately preceding the event giving rise to the claim for liability.

Termination

Mamuupayz may suspend or terminate your use of the Mobile App or any Service if it believes, in its sole and absolute discretion that you have breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Use or anyway otherwise acted unethically. Notwithstanding anything in this clause, these Terms of Use will survive indefinitely unless and until Mamuupayz chooses to terminate them. If you or Mamuupayz terminates your use of the Mobile App or any Service, Mamuupayz may delete any information relating to your use of the Service and Mamuupayz will have no liability to you or any third party for doing so. However, your transactions details may be preserved by Mamuupayz for purposes of tax or regulatory compliance. Either party shall have the right to cease/terminate the relationship by giving each other a prior twenty four (24) hours written notice.

Governing Law

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of courts, tribunals, fora, applicable authorities at Bangalore.

As an additional benefit of using Mamuupayz, we may reward credit points to you from time to time. The reward schemes vary from one merchant to another and the details would be available in the Mamuupayz application. The reward points will be given in the form of credits that only be redeemed at Mamuupayz merchants. Currently, 1 credit point can be redeemed as Re.1 in an Mamuupayz merchant transaction. A maximum of 25 credits can be rewarded in a day. A maximum of 100 credits can be received in a calendar month. Any credits rewarded will be available for use after a minimum of 24 hours. At some merchants, only 50% of the Credits available in app can be redeemed in an Mamuupayz merchant transaction. The Credits can be redeemed in next 90 days after receiving it. After the 90 days, the credits will be automatically voided and cannot be redeemed. Only a fixed portion of the Credits available can be redeemed per day. Currently only 100 credits can be redeemed in a day. Referral Credit Rule: 25 credits are awarded when the referee completes a successful transaction using his bank account, Credit/Debit Card or Wallet. A maximum of five referrals are allowed per user. After 5 successful referrals, no cash back will be awarded. We reserve the right, at our sole discretion, to change, modify, add or remove Credit value, its validity, reward policy & its redemption policy at any time without any prior written notice to You.

What is NPCI?

NPCI is an authorized payment system operator by RBI. NPCI owns and operates UPI payment system.

What is PSP bank?

PSP is the banking company authorized to act as a Payment Service Provider (PSP) under the UPI framework. PSP engages the TPAP to provide UPI services to the end-user customers.

What is TPAPs?

Third Party Application Provider (TPAP) is an entity that provides the UPI compliant app(s) to the end-user customers to facilitate UPI based payment transactions.

What is Customer's Bank?

The Bank where the end-user customer maintains his/her account and has linked the account for the purpose of debiting/crediting the payment transactions made through UPI.

Who is End User Customer?

The end-user customer is the individual who uses UPI payment facility to send and receive payments.

We hereby confirm that:

We Mamuupayz are a TPAP authorized by NPCI to facilitate payments through IDFC Bank/s. We are a service provider and we participate in UPI through PSP bank. We are bound by the tripartite agreement entered with the sponsor PSP (with name of the PSP banks to be provided) and NPCI. We are responsible for facilitating grievances / complaints resolution of the customers on-boarded on our UPI application. We shall be the first point of contact for all UPI related grievances/complaints for customers on-boarded by us. In case the complaint/grievance remains unresolved, the next level for escalation will be the PSP Bank, followed by the bank (where you maintain the account) and NPCI in the same order. After exercising these options you can approach the Banking Ombudsman and / or the Ombudsman for Digital Complaints, as the case may be.

Roles & Responsibilities of NPCI

NPCI owns and operates the Unified Payments Interface (UPI) platform NPCI prescribes rules, regulations, guidelines, and the respective roles, responsibilities and liabilities of the participants, with respect to UPI. This also includes transaction processing and settlement, dispute management and clearing cut-offs for settlement NPCI approves the participation of Issuer Banks, PSP Banks, Third Party Application Providers (TPAP) and Prepaid Payment Instrument issuers (PPIs) in UPI NPCI to provide a safe, secure and efficient UPI system and network NPCI provides online transaction routing, processing and settlement services to members participating in UPI NPCI can, either directly or through a third party, conduct audit on UPI participants and call for data, information and records, in relation to their participation in UPI NPCI provides the banks participating in UPI access to system where they can download reports, raise chargebacks, update the status of UPI transactions etc.

Roles & responsibilities of PSP Bank

PSP Bank is a member of UPI and connects to the UPI platform for providing UPI payment facility to the PSP Bank and TPAP which in turn enables the end-user customers / merchants PSP Bank, either through its own app or TPAP's app, on-boards and registers the end-user customers on UPI and links their bank accounts to their respective UPI ID. PSP Bank is responsible for authentication of the end-user customer at the time of registration of such customer, either through its own app or TPAP's app PSP Bank engages and on-boards the TPAPs to make the TPAP's UPI app available to the end-user customers PSP Bank has to ensure that TPAP and its systems are adequately secured to function on UPI platform PSP Bank is responsible to ensure that UPI app and systems of TPAP are audited to safeguard security and integrity of the data and information of the end-user customer including UPI transaction data as well as UPI app security PSP Bank has to store all the payments data including UPI Transaction Data collected for the purpose of facilitating UPI transactions, only in India PSP Bank is responsible to give all UPI customers an option to choose any bank account from the list of Banks available on UPI platform for linking with the customer's UPI ID. PSP Bank is responsible to put in place a grievance redressal mechanism for resolving complaints and disputes raised by the end-user customer

TPAP is a service provider and participates in UPI through PSP Bank TPAP is responsible to comply with all the requirements prescribed by PSP Bank and NPCI in relation to TPAP's participation in UPI TPAP is responsible to ensure that its systems are adequately secured to function on the UPI platform TPAP is responsible to comply with all the applicable laws, rules, regulations and guidelines etc. prescribed by any statutory or regulatory authority in relation to UPI and TPAP's participation on the UPI platform including all circulars and guidelines issued by NPCI in this regard TPAP has to store all the payments data including UPI Transaction Data collected by TPAP for the purpose of facilitating UPI transactions, only in India TPAP is responsible to facilitate RBI, NPCI and other agencies nominated by RBI/ NPCI, to access the data, information, systems of TPAP and carry out audits of TPAP, as and when required by RBI and NPCI TPAP shall facilitate the end-user customer with an option of to raise grievance through the TPAP's UPI app, e-mail, messaging platform, IVR etc. for redressal of customer grievances Dispute Redressal Mechanism Every end-user customer can raise a complaint with respect to a UPI transaction, on the PSP app / TPAP app. End-user customer can select the relevant transaction and raise a complaint in relation thereto A complaint shall be first raised with the relevant TPAP in respect to all UPI related grievances / complaints of the end-user customers on-boarded by the PSP Bank (if the UPI transaction is made through TPAP app). In case the complaint / grievance remains unresolved, the next level for escalation will be the PSP Bank, followed by the bank (where the end-user customer maintains its account) and NPCI, in the same order. After exercising these options, the end-user customer can approach the Banking Ombudsman and / or the Ombudsman for Digital Complaints, as the case may be.

The complaint can be raised for both the types of transactions i.e. fund transfer and merchant transactions The end-user customer shall be kept communicated by the PSP / TPAP by means of updating the status of such end-user customer's complaint on the relevant app itself

Information we collect

Mamuupayz reads the text messages (SMS) received by you from various service providers, including but not limited to financial institutions, mobile service providers, utility companies and retail outlets; related to one or more transactions, including availing services, orders, billing and renewal notifications. The information in these text messages enable us to provide you the most user friendly payment experience. The application only accesses business messages that usually originate from alphanumeric senders and does not include messages that originate from 10 digit numeric numbers.

Registration Information:

At the time of registration with Mamuupayz, an Mamuupayz account is created for the user with user’s email address and mobile number. Additionally we also capture phone related information such as IMSI, Device Name and Android Version. Depending on the payment service availed; user might need to provide Bank account number, Credit/Debit Card number, Card Expiry Date, Name on Card. All the above information is securely stored within Mamuupayz Systems as per the PCI DSS standards. Further to that, encryption mechanisms are used to protect the transmission of this data to Mamuupayz backend servers.

Transaction Information:

When the user conducts a transaction, Mamuupayz may collect transaction information which may include – Date, time, transaction amount, Merchant, payment method, Payment instrument, location, email and phone number of user and merchant, offers associated with transaction, description of transaction.

Log File Information:

When you use Mamuupayz, our servers automatically record certain information that your device sends to our servers. These server logs may include information such as your web request, Internet Protocol (IP) address, platform type, browser type, browser language, web request, referring/exit pages and URLs, domain names, amount of time spent on particular pages, the date and time of your request, your phone number and status information. When you use the Mamuupayz mobile app, our servers log certain general information that our application sends whenever payment related activity is performed in the app.

How we use the information we collect

We use information provided by you to operate, maintain and provide to you the features and functionality of Mamuupayz service. In particular, your mobile number is essential to your use of the Mamuupayz service and will be retained. Billing/bank account details are stored (until deleted by you) in our secure and PCI-DSS certified infrastructure. Transaction logs are stored as per the tax and regulatory compliance. Since the application is in the financial space, certain information elements such as email addresses and device details are used in the fraud detection module in order to serve you better. We may use both your information (such as anonymized usage data, IP addresses, platform type etc) to improve the quality and design of the Mamuupayz service to create new features, promotions and functionality by storing, tracking and analysing user preferences and trends.

Information we share

We respect your privacy and share your information with 3rd parties ONLY on need basis in order to fulfil the service being provided to you. These cases include: during registration, using your mobile phone number for verification, either by SMS or a phone call; during transaction, sending the bank account credentials to the banking partner in order to complete the transaction. In both these cases, we ensure that the communication is secured to utmost security levels. We may also need to share the information with government agency in order to comply with the law. Other than the cases mentioned above, we don’t share any personally identifiable information to any other third party. We use Analytics tools, such as Google Analytics, to understand the trends and improve upon our services. We share only non-personally identifiable information for this purpose and the data would consist of cookie and usage data, with usage data being category and action information.

Consent

By using Mamuupayz, you consent to the collection and use of the information you disclose to us in accordance with this Privacy Policy, including but not limited to your consent for sharing your information as per this privacy policy.
